O juiz Gilvandro de Lelis Oliveira, da 4\u00aa Vara do Trabalho de Ribeir\u00e3o Preto (SP), proibiu a Companhia de Desenvolvimento Econ\u00f4mico de Ribeir\u00e3o Preto (Coderp-RP) de demitir empregados sem o aval da entidade.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 13.2pt; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; text-align: left;\"><span style=\"font-size: 18px; font-family: Helvetica, sans-serif; color: black; letter-spacing: 0.25pt;\">A decis\u00e3o \u00e9 liminar, at\u00e9 que seja julgado o m\u00e9rito da a\u00e7\u00e3o e prev\u00ea multa de R$ 1 mil no caso de descumprimento, para cada rescis\u00e3o contratual dos funcion\u00e1rios. Ela s\u00f3 vale para aqueles contratados h\u00e1 mais de um ano pela companhia.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 13.2pt; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; text-align: left;\"><span style=\"font-size: 18px; font-family: Helvetica, sans-serif; color: black; letter-spacing: 0.25pt;\">De acordo com o magistrado, autorizar a dispensa sem o sindicato poderia levar \u00e0 redu\u00e7\u00e3o dos\u00a0<a href=\"https:\/\/www.huffpostbrasil.com\/news\/direitos-trabalhistas\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: blue; text-decoration-line: none;\">direitos trabalhistas<\/span><\/a>. &#8220;Do exposto, tem-se demonstrada a probabilidade do direito bem como o perigo de dano aos trabalhadores que poder\u00e3o eventualmente sofrer preju\u00edzos pela falta de assist\u00eancia nas rescis\u00f5es contratuais&#8221;, escreveu na\u00a0<a href=\"https:\/\/www.conjur.com.br\/dl\/empresa-homologar-rescisao-contrato.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: blue; text-decoration-line: none;\">decis\u00e3o<\/span><\/a>\u00a0de 19 de abril.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 13.2pt; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; text-align: left;\"><span style=\"font-size: 18px; font-family: Helvetica, sans-serif; color: black; letter-spacing: 0.25pt;\">O juiz afirma que a conven\u00e7\u00e3o coletiva em vigor prev\u00ea o acompanhamento das demiss\u00f5es pelo Sindicato dos Trabalhadores em Processamentod e Dados e Tecnologia da Informa\u00e7\u00e3o (SindPD), autor da a\u00e7\u00e3o.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 13.2pt; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; text-align: left;\"><span style=\"font-size: 18px; font-family: Helvetica, sans-serif; color: black; letter-spacing: 0.25pt;\">Para o presidente do SindPD, Antonio Neto, a decis\u00e3o mostra o compromisso com os trabalhadores. &#8220;Devido ao acordo firmado na primeira rodada de negocia\u00e7\u00e3o com o sindicato patronal, a Conven\u00e7\u00e3o do Sindpd de 2017 est\u00e1 v\u00e1lida em sua integralidade, portanto as empresas s\u00e3o obrigadas a seguir a Conven\u00e7\u00e3o, fruto de acordo estabelecido na negocia\u00e7\u00e3o&#8221;, afirmou.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 13.2pt; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; text-align: left;\"><span style=\"font-size: 18px;\"><span style=\"font-family: Helvetica, sans-serif; color: black; letter-spacing: 0.25pt;\">Trecho do artigo 477 da\u00a0<a href=\"https:\/\/www.huffpostbrasil.com\/news\/clt\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: blue; text-decoration-line: none;\">CLT (Consolida\u00e7\u00e3o das Leis do Trabalho)<\/span><\/a>, que trata das rescis\u00f5es, previa que o pedido de demiss\u00e3o ou recibo de quita\u00e7\u00e3o de rescis\u00e3o de contrato de trabalho dos empregados com mais de 90 dias s\u00f3 seria v\u00e1lido com a assist\u00eancia do respectivo sindicato ou perante a autoridade do Minist\u00e9rio do Trabalho e Previd\u00eancia Social ou da Justi\u00e7a do Trabalho.
